Abstract:

As one of the emerging products of online media technology, short videos are

generally considered to belong to the category of “works” under copyright law. As one of the

emerging products of online media technology, short videos are generally regarded as forms of

expression within the scope of “works” under copyright law. Along with the rapid development

and popularity of mobile Internet, the issues of infringement and protection of short videos have

gradually become the focus of public opinion. The disorderly competition in the short video

market and the complexity of the right protection methods in the Internet environment have made

it difficult to defend the copyright of short videos. Based on this, this paper proposes that the

protection of short video copyright can be improved in four aspects: improving the legal basis,

increasing the obligations of the platform, strengthening the judicial connection of law enforcement

and enhancing the application of the “red flag principle”.
