A Discourse on Requirements for Justification for Chinese Online Information Regulation from the International Human Rights Conventions’ perspective

Abstract:

This paper analyzes specific provisions of international human rights conventions on the restrictions on the right to freedom of speech, and summarizes three requirements for justification for online information regulative activities, i.e., regulation should have legal basis provided by the laws, regulation should comply with the principle of proportionality, and the regulated parties should have effective remedies.
