Abstract:

Due to sticking to the dimension of private right protection, the technical protection measures have been incapable of fully protect the copyright in the digital age. Improving the technical protection in the competition law dimension
can eliminate the conflict among the technical protection measures, the market competition order and the consumers’
rights. So building the system of technical protection measures to meet China’s industrial-development-oriented value
can balance the interests between the copyright owners and related subjects of the right.
