Abstract:

The legal status of technical protection measures largely depends on the balancing of interest between copyright holders and the public. In China， the rules of technical protection measures are relatively rough. Specifically， the protection of copyrights and technical measures should be distinguished. In the setting of rules， the infringement of the technical protection measures should be identified more closely， including the standard of effective technical measures， the circumvention， and the role of fault. At the same time， the fair use rule should also apply in the whole process.
