Abstract:
The present government regulatory oversight of culture industry in China is “healthy development-oriented”, which puts a stable and sound development as a priority, aiming to avoid practice of not meeting the public interests and malfunction of the market. As a result, multiple government departments are involved in the regulatory mechanism and they practice all-in-one administrative oversight over all elements in the culture industry. The mechanism highlights the government as the authority, the administrative measures as the implementation tools and the administrative regulation as the guarantee in the process. Problems thus arise in the conflict between the management concepts and the enforcement models, such as the unscientific and unreasonable structure of the oversight mechanism and the blockade in coordination work. This paper proposes a regulation model with clarified responsibilities by an improved division of administrative powers. The purpose is to build a more scientific and reasonable regulatory structure espoused by the government watchdogs as the main regulators and the NGOs as the facilitators to give impetus and legal support to the oversight of the culture industry. A strengthened legislation will help overcome problems of not meeting the public interests and malfunction of the market.
