Abstract:

The article has studied on the copyright infringement responsibility of the network service provider on the law
of tort liability. The tort liability should apply the principle of fault. The “ know” should be interpreted as“ already known”.
The network service provider should be set necessary conditions if he took necessary measures. The scope of compensation
of the network service provider shoud apply to statutory compensation system.
