Abstract:

Based on the interests balance between the copyright owner’ s rights and the public rights, the paper
discusses the relationships of the copyright restriction with the three parts: the constitutional human rights protection,
economical rationality and the practice developments of OA and CC, and it put forwards that under the network
environment the copyright restriction should be appropriately strengthened.
