通过解读印度“德里大学影印案”司法判决， 探讨该案所涉印度版权法教育使用例外制度的立法规 范与司法解读， 解释该制度的价值取向及其历史渊源， 阐释该案所体现的反转例外制度解释规则与道德理论内 置型司法推理方法之司法审查智慧。
Abstract:
Thispaperexploresfirstlytherelativelegislativeregulationsandjudicialreviewsontheexceptions andlimitationsforeducationintheIndianCopyrightAct1957viadiscussingthejudgmentsof “DelhiUniversity photocopycase”，andthenexplainstheirvaluedispositionandhistoricalorigins;finally，itelaboratesthe reversaloftheruleofinterpretationofstatueonprovisosandexceptionsaswellastheory-embeddedjudicial reasoningreflectedinthejudgmentsofthecase，whichmaybelessonsfortheChinesecourtstodrawfrom.
