Abstract:

The exclusive publishing power of standards, national, industrial or local standards owned by a few
publishing houses stipulated by some regulations, is being received more attentions or debates in publishing trade and
legal community. The article urges that the standards developed and revised by provincial agencies and/or above are not
the subject matter of copyright in China, that those agencies have not the eligibility for copyright owners, and that allocating
the exclusive publishing power by the administrative power is suspectable of abusing the administrative power and leading
to concentration of business operators which is of antitrust nature as well as has the suspect of failure to fulfil statutory obligations of disclosing government information assumed by those agencies.
